If you apply and fill out a BR application for yourself online (which I understand you then have to take 3 copies to the Court when you get your appointment), does this in anyway prevent you claiming exemption from the £150 court fee if you are on certain benefits? The reason I ask is because I came across something about not being able to get this if you applied online using MCOL or PCOL
Also, is it correct that being on Working Tax Credit does not automatically mean you can get the fee waived – our earnings last year were around 16.5K but we do not claim the Child Element not are we on Pension Credit nor DLA etc? I read somewhere that it may in our circumstances be discretionary and that we could have to prove “undue financial hardship” (I would have thought that applied to everyone who was going BR anyway!)

Hi - thanks for your input. We can but hope that they will be considerate to us if this ends up being discretionary (hardly likely if the Gov pot is currently full of holes though..)
just to make it harder to access the pot some of the courts and regions have slight different processes
it may make sense to use the above link to court finder and then contact your local court, ask for the bankruptcy clerk, then ask the question about submitting the form 150 and what other paperwork they require.
I am aware of one court wanting the paperwork in two weeks in advance or else they will not give reduction in fee on the day.

I know the pot is emptying but it is made harder with bureacrats putting extra obstacles in the way, protecting the pot as if they own it ! if by the rules you are entitiled to it you should be allowed to claim it
