Afternoon all,
Quick question for the experts on this forum...
I was declared bankrupt last year (December), recently arranged an IPA that I think is reasonable (actually haggled and got it reduced from initial value). Last month my wife decides she's had enough and leaves and takes the kids with her.
Stressful enough, but do I contact the IS about my IPA seeing as my circumstances have changed? I checked over all the documentation they sent me and it ONLY says let them know if my income changes - well, my income HASN'T changed but my outgoings have (slightly) gone down. Am I legally expected to tell them? If I do I'm shafted, but I really want to do what's right - all this has been such a nightmare I don't want to make it worse by withholding info that I should tell about..
Any advice gratefully accepted!!!

| You will need to contact the OR (or RTLU if your case has been passed to them) as your outgoings would have reduced. When you sign your IPA form you agree to tell the OR/RTLU of any changes to your income or circumstances so not telling them could land you in hot water. |

You absolutely need to contact them and they will send you out a new Income / Expenditure to complete.
Lots of changes so do it in rough first.
Household income has reduced ( child benefit / working tax credit / wife contributions etc )
Expenditure has changed considerably but even though the children aren;t with you you will still need to put down contributions for children etc

Gettingoutofdebt mentions that if your case has been passed to RTLU, you need to correspond with them rather than the OR. Is this correct? The OR who was dealing with my case initially seemed very reasonable, whereas the dealings I have had with the RTLU seem much more draconian. They seem to want every penny you earn, even if it is a small one off amount, whereas the OR was much more lenient. My income went up by £40 per annum a few weeks back, but I have not told anyone yet as I assumed it was a negligible amount.

When I had to have my IPA reassessed I contacted the original OR's office that I dealt with (Moon Beever couldn't/wouldn't help) and I was referred to the RTLU as they no longer held my case.

I received a letter from the OR about 5 months into my BR saying that my case had been transferred to the RTLU and I should contact them for any issues regarding the BR rather than the OR. I haven't had any need to contact the RTLU yet (was discharged last Nov) but I have also seen quite a few cases on this board where the OR is definitely more lenient than the OR. I'm not too sure whether there is more pressure put on the RTLU to get money from BR people or whether the RTLU are going by the exact letter of the law, as it were, whereas the OR is a bit more flexible. |

I was never notified that my case had been passed to the RTLU.
I do feel that they are more harsh than the OR - I'd had an £80 per month pay cut and the cost of living had gone up but the RTLU only reduced my IPA by £25 a month.
With hindsight I wish I'd questioned it, asked for the figures as I know they disallowed some things. The problem was I just wanted it all sorted out.
