 IVA is taking all of my DLA less £50

Hi I am in an IVA and due to continued illness I am no longer able to work and the IVA is taking all of my DLA less £50.00. This week I have been diagnosed with yet another debilitating condition and need my DLA (non means tested) to maintain my daily disability needs. I am now considering going bankrupt as this seems the best option open to me. My husband is now my carer so we have no income other than carers benefit and income support. Things are pretty bleak at the moment and am receiving no support from my IVA provider. Any suggestions or am I slowly moving in the right direction. Thanks for your time and take care.

Hi Dee

your first point of call should be your IVA provider if they are not able to assist

1) how long have you been in the IVA is their a provision to pay for the bankruptcy.

2) if not, once you have taken advice from one of the experts to the left, (cars, houses, savings, pension etc will need to be discussed and planned before action) you have to miss 3 IVA payments a get a certificate of failure.

3) you will have to petiton at the local court, you can do the paperwork yourself or get some one to assist.

4) you will have to show why the previous figures for IVA are no longer effective and valid for you current situation but you have already explained that above

5) bankruptcy will be for a period of twelve months as you are both on benefits it is unlikely that you will get an income payment order.

6) any joint debts will pass to the other named person
