I am looking into the prospect of going bankrupt and I would like to know if I qualify? I have was overpaid wages of £7816.31 by a previous employer whilst on a career break , I started to pay off the amount on a payment plan of £40p/m but I have been out of the UK, in Australia and was unable to keep up the payments as I am unable to work due to visa restrictions and didn't have the money - especially to cover the excess of international transfers. I have decided that I will be moving to Australia permenantly but my previous employer has contacted me via a solicitor advising that if I don't make a payment of the remaining £7456.31 then I will be taken to court and proceedings will continue through the County Court. I have no way of paying this money so think that bankruptcy is my option. I will be returning to the UK in August for 1 month, is this enough time to file for bankruptcy, and will my debt, through overpayment of wages be cleared if I do go bankrupt? I will have been ion Autralia for 1 year on a tourist visa although I still have bank accounts set up in the UK. Will I have to apply for bankruptcy in London at the High Court, or will I be able to apply in Exeter where my bank accounts are set up? Kind regards Tamsin Paterson |

I would not contemplate bankruptcy at the moment and you might not even be allowed to make yourself bankrupt as you owe so little. A Debt Relief Order may be the best way forward as you owe under £15,000. The main criteria are debts under £15,000, no assets over £300 and disposable income under £50 per month. You can apply online or seek help from Citizens Advice Bureau or National Debtline on 0808 808 4000.
