Hello,

I've pretty much prepared to petition for bankruptcy this week (and booked a court slot). But I'm really not sure whether to hold off for a month (or more?).

I've used credit for some basic things up until about 10 days ago, and am totally insolvent. Also now effectively unemployed after resigning directorship.

Is it too soon to declare BR? Would the OR take a dim view of going almost straight from using credit resources to declaring BR? There's been *no* intention before now of *ever* defaulting on payments or going down the BR route. But I know how sometimes in life things can look differently on paper, despite the very best of intentions.

By the way, am well over 30k in debt, mostly cc's and overdraft from years of low-salaried day-to-day living while trying to grow a ltd company.

Any fast advice appreciated!
Ajay

If you don't go ahead with this now, how are you going to manage for the next month or so?

I take it you have the cash ready for the fees?

Yes - I have just about scraped together money for the fees.

The same way I would have to manage if bankrupt.
I'm not too sure how that relates to the questions though?

I was just wondering how you manage to scrape by for a while as you have been using credit to fund your day to day living.

As soon as you know that you are insolvent you should stop using credit but you should just need to tell the OR.

Once you are bankrupt then the OR will go through your finances to see if you have enough DI for an IPA.

You should get a new bank account if you've not already done so - the Co-op come recommended.
