 I have received a B178 Notice of application. Should I get legal advice ?

I have received a B178 Notice of application to register restrictions against my property. I am not bankrupt but my ex husband was declared bankrupt and although he has not paid any mortgage payments since we split 3 yrs ago he is still named on title deeds for property. When I contacted the OR they told me that they only have an interest in his claim and that it is only for 3 years, are they being honest with me or should I get legal advice?

Hi and welcome.

They are being honest with you - they will usually keep the interest for 2 years and 3 months and then look at it again. If they then have no more interest in it then it will revert to you.

I'm sure one of the experts will correct me if I'm wrong.

Not a lot if any, there could be 2 or 3 grand but no more than that especially with the house prices at the moment.

then as kallis says they will probably wait until the 2 year 3 month point and look at it again then, as you are an ex spouse then they legally have 3 years to start the process of dealing with any equity
