 Can trustees make me move to a smaller house ?

Will be bankrupt in the next month or so, as debters are threatening this. Was wanting to know if my trustee can make me move to a smaller house, and cheaper rent? I pay slightly over market value, but is near to my son's school, as he is autistic. I would also like to know, if they take all of our surplus income to go towards the debts. And do they count my son's DLA and disability element of child tax credit as income? sorry I have so many questions! Thanks

Hi Carolynne

Which of your creditors are threatening to make you bankrupt? I ask because many creditors will threaten but very very few will actually go through with the threat. In fact the only creditor where there is any kind of risk of this is HMRC. As such if you do not owe money to HMRC I do not think you have much to worry about.

Having said that if you were to be declared bankrupt, it would be unlikely that the OR would ask you to move particularly if your son has particular medical requirements. In addition, the OR will not take your son's DLA into account when considering your income. This money is deemed to be required for his upkeep and cannot be touched.
