I have received a letter from my previous district council saying that I did not pay the correct council tax on the property that I lived in 12 years ago. They have claimed in the letter that they have have been trying to get in touch with me for 12 years but i have heard nothing till today. When we moved the solicitor checked that everything was paid and up to date. There is nothing on my credit report about this either. The letter states that I have seven days to pay the amount or I will be arrested. I have spoken to them and they are being very unhelpful regarding this. The bill is for £1700.
Sorry to hear you are going through this. I would have thought that after 12 years, you would no longer be liable for this outstanding amount, but I could be wrong. I'm not sure why the council involved has taken 12 years to 'track' you down. I'm sure they have many ways of trying to find out where people are who owe them money. The electoral roll for one. I'm sure an expert will come along shortly and be able to help you. Failing that, a visit to citizens advice might be able to give you informaton on this.
As the debt is more than 6 years old then the council van request a Liability Order. This means that they can deduct the money from your wages or benefits. They will be granted the order unless you contest it.
They're not covered by the Statute of Limitations Act, they have their own regulations for this.
