Morning all,

Could someone please let me know how much creditors are told of our personal circumstances (reasons we got to where we are etc)? I only ask because one of our creditors is my father-in-law and to avoid any disquiet within the family we'd rather hedidn't see some of the things on our SOA about reasons for debt etc.

Any ideas?

Hey CG and Morning
I dont know about that one. I know a report is sent to the creditors explianing that we are now BR and what assets we have for disposal to them.
As for what is actually given to them i dont know.
Maybe John or Suzanne will know that answer as i would like to know also.
If they do have to declare all info maybe you could speak to your OR and see if there is a way round it when it comes to your inlaws.

Hi

The creditors will get about a paragraph within the report to creditors that gives a very brief explanation for the insolvency, so no real details.

At the end of my interview the OR asked me to sum up in a sentence the reason for my insolvency, he said that people always struggle with it and take my time as it is this he would forward to the creditors as a way of an explanation.

This is where we have a problem!
Remember about our white lie where we said hubby had been with his empolyer longer than he had? Well thats fraud! OR will ask us how we got into this mess, we will say, "hubby been out of work....." as one of our reasons, they will then tell creditors, creditors will look at application form.......

Need I say more?

I don't think creditors will even put two and two together, if they even read the reports, and I have my doubts about that.

I agree totally. Creditors behaviour has always been quite strange, but these days, it can be positively bizarre!

If you took credit out at least 31/2 years ago and you have defaulted on that agreement and are in a dmp can the creditors still go back and chexk the details given to them at the time you took the credit ie what wage you put down or is that agreement now null and void aa we have broken the oroinal terms of the agreement.

Hi jane

I think creditors have little time to spend doing this kind of checking up unless they believe there may be serious fraud for large sums involved. It is well known how pushed they are for time generally and I don't think they would waste time going back to old agreements if there was going to be no potential gain.

Hi Suzanne

Is 5 years the furthest back they can go. The agreement i was concerned about was 4 years the ammount I owe is £4200 we I am paying on a dmp and they are accepting this subject to 6 monthly reviews. The majority of both mine and my husbands debts was taken out over 5 years ago.

Just want to add here that it seems really silly that to the creditors we are just another number.

They give give give then when you need help they are unwilling most of the time to show the human side of things, yes we should know when to stop but when we get in a mess like we all have its heart breaking because basically they dont give a damn.

The call centres for these places are a right pain, usually in India, (No disrespect meant) and then they have so many departments that you send a letter and you never get a response as no one ever gets it.

I think a lot of our debt problems are down to the BANKS and credit places and they should be brought to trial.

The prog i watched the other day gives the CE of these places millions in bonuses but give nothing back to us meare mortals that now we have lost everything.

They however live in nice homes, dont worry about paying the credit card per month or the mortgage and i think they need to be brought in to answer for a lot of this mess that we are in and the country is in right now.

Sorry i just wanted to air my views. Im off now. :)
