 hi,i went bankcrupt on 13th aug

hi,i went bankcrupt on 13th aug 2008.my perssonnel debt amount to £52000(fifty two thousend)the debt was perssonal loan and credit cards only.i have two houses which are mortgaged.my first house is in joint names with my wife and my second house is sole in my name.both houses were brought only 3 years ago i have only ten thousends pond equity each.the second house is rented to tenants which covers the mortgage.i have been fired from my job and now on job seekers allowance.i have missed three month mortgage and waiting for reposition.can i go as homeless to local authorty.i have wife and three kids under 6 years.the mortgage is very high and i want it to be repossed.the mortgage is £1300 intrest only.i have been told the propertys will be eventually be repossed by the official reciever anyway.

Hi

as the mortgages appear to be too expensive to sustain the repayments it is likely, as you say, that you are facing repossession on both.
You should contact your local housing authority and make an appointment to discuss your position. Some authorities try and fob you off but they do have a duty if you become homeless. That said that duty does not apply until you are actually evicted.

If local authority is your only option you should not walk away from the current property but wait for eviction otherwise your LA coould argue you have made yourself intentionally homeless.
The availibility of LA housing varies from council to council. Hopefully yours will not be suffering from a shortage.

You may have to go into temporary accommodation for a while until something more permanent can be found.
