| hi i got a letter this morning saying if i dont cooperate fully i could be declared bankrupt immediately but i read when i do go bankrupt some one can break in and take my goods worth money |

If I assume that the letter was from a creditor chasing you.
That is really a bit naughty frightening you about Br " if you don't cooperate"
To make you Br they need to serve a STATUTORY DEMAND then cannot do anything for another 21 days, then they can petition for Br but that would take 2 - 4 weeks and cost them between £1500 and £2000.
Nobody is going to break in and take goods.
Baliffs have the right to enter your property if they are evicting you - but won't take goods.
Alternatively if a creditor pursue's you and gets a CCJ they could eventually instruct bailiffs - HOWEVER if you never allow them in they cannot break in.

Hi Becky and welcome to the forum.
Please don't worry about people breaking into your house and taking things if you're made BR, it really doesn't happen. I was worried about possessions being seized when I went BR (especially as anything of value belongs to my OH!) but it doesn't work like that.

| i keep think can i go to prison 4 this i know its silly but i have got a little one to think about and also wot will happen if i just dont do anythink about the letter wot will happen will they come knocking on my door |

Hi again, please don't worry about prison, that's not going to happen. However, please don't bury your head in the sand, you need to get this sorted out. How much do you owe in total?

| to the ones that r saying they r going to make me bankrupt 839.15 for a car that we got from yes car credit and sent it back within a month and they sed they sold it for 1500 and that we still owe them that |

It would be a shame if you were to have to go BR for that amount. You need to take advice about this, why don't you contact either the CCCS or your local CAB?

| i cant afford to pay the fees to go br cost i am on benefits can i go to prison if i dont pay it and they cant break in to my home to take my things can they and wot do u think i should do about the letter because the last time i go one i phoned them and they just put the phone down on me thanks |

As I said it would be awful if you had to go BR for such a low amount, although I know it doesn't seem low to you.
If you call the CCCS (Consumer Credit Counselling Service) or CAB they will be able to advise you on the best way forward. They may be able to contact your creditors to offer a token payment.
You're not going to go to prison, the only debts you can go to prison for are non paid fines or council tax, and even then there is a legal process that has to be followed and you would get a chance to speak to the court. No-one will break into your house. However, you do need to deal with this.

I am sorry to hear about the situation that you are presently in.
I agree with Skippy in that NO you wont go to prison but YOU do need to get some advice and try and get this sorted once and for all.
You could call our helpline and ask themi if they can go through any options with you, but honestly you need to get this sorted and the sooner the better.

If that amount is all you owe it would be a shame to petition your own bankruptcy. Unless you have advised these people that you have substantial assets I would be surprised if they would really try to make you BR. It would cost them £495 plus. There would be no guarantee they would get anything out of you either. Was this a hire purchase agreement? If you have the original loan documentation please show it to someone like the CAB to see what you are really liable for. If you do not have the original loan loan details send a recorded delivery letter to the loan people requesting details (and asking that they contact you only by letter). This will shut them up for a while and you can fully investigate where you stand. Don't let them bully you and good luck. |

It would actually cost them a lot more than £495 to make Becky BR, more like £1500+. Only a debtor's petition costs £495, so it really wouldn't be worth their while.
