Hi,

After a period of quiet, I have obviously reached the top of someones pile now. IPA finally starts in Jan, and also I got a letter asking me to come in to discuss my gambling/spreadbetting in a 2-3 hour face to face interview so they can compile a letter to the secretary of state.

I am assuming this is for a BRO/BRU?

I am very worried about this, particularly of risking ruining all future employment opportunities (and current employment) as my actions will be advertised for all to see for 6+ years.

I am also worried about the length of the interview...I have sent them all my spreadbetting statements to cooperate.

Hoping I can talk my way out of a BRO...isnt gambling an illness? My GO put me on valium and referred me for Cognitive therapy....

Hi

Have you gone to gamblers anonymous? Or have you received help or counselling for gambling. If you have the face to face interview with the OR is the place to mention this.

I have known of someone who gambled £7.2 million and had his bankruptcy extended by way of BRU by ONE year.

At the end of the day it is the ORs responsibility to investigate all potental possibilities of misconduct.

On the other hand you are on tablets and undergoing CBT which would act in your favour.

I hope this is of help.

With respect to employment I have not heard that bankruptcy has ever affected someones employment possibilities (where there has been no indication of fraud)

Hi,

I havent gambled for close to 2 and a half years now. Tries to pay the money back on a DMP for 12 months, but they wouldnt freeze the interest so I was going backwards and not forwards.

I went to GA, but hated it and so got over it by handing my salary over to my wife and getting family support.

I have been told that gambling puts me at possibly the lower end of the middle band of a BRO, bands being 1-5 years, 6-10 and 11 - 15. So I am looking at 6 years minimum. Dont think what I did was any less responsible than people who bought things they couldnt afford (for example, at least I may have won it back...!).

Need to know where I stand. If I can haggle down to a few years, because (1) no fraud (2) I tried to pay the money back (3) I am remorseful (4) I havent gambled for 2.5 years then I would like to do so. If they have a general rule which says "gambling is bad and gambling is 6 years minimum" then I am worried.

While I know I am no criminal, when you go to work for big companies, banks etc, who are worried about reputation....taking me on when I am listed as a gambler....!? I am worried about my current job because I havent told them about my BR, but I am still running round with their company credit card (need it for travel etc.). Although I did check with HR that there wouldnt be a problem....I didnt tell them the reason why.

Hi Indi

From what you said. I don't feel the OR will be harsh on you.

Go to the insolvency.gov.uk website and look at the current BRU/BROs I think you will be astonished what you have to have done to get a 6 year BRU/BRO -all cases are listed.

You may only get a year or two extention to your Bankruptcy.

Check the government website out you'll see what I mean. It may give you hope :-)

PPS Regarding the company credit card. You may be able to keep this in bankruptcy. Technically it belongs to the company who underwrites it(normally your employer)

I have know personally 2 cases where a company credit card was allowed. It allowed the individuals to pay for their expenses and claim them back aiding their cash flow.

Hi,

I think I am OK with a company card from the OR perspective as it is not my debt. My issue is that I havent told the company I work for....You have me slightly worried now in that it seems you have to ask permission to use a company credit card and its a special case if you can keep it. All the advice I have sought has said its fine, and I havent even told the OR. I am using Brett as my rep and this is the advise he gave me.

p.s. I have looked at the BRO site, and while you see some very dodgy activity for 6 year BROs, you also see the odd example of people who sold a car to their dad 6 months prior to BR and got 7 years...seems a bit harsh.

Hey indy

Whilst i know absolutely nothing about gamblimg and getting bro/u because of it. When you explain to the or everything you have said here they will certainly get a clearer picture of your situaion. I would also like to say WELL DONE for not gambling for so long, that is really something to be proud of. You tried your best to pay your debts back, however this was made impossible by lack of support from your creditors.
