Hi all! We rent privately and have been here nearly 5 years. We are just filling out the forms to go BR as our IVA has failed. Looking through the posts on this fantastic site prompted me to check our tenancy agreement and I found a part that I do not understand and wondered if anyone can help..."PROVIDED ALWAYS AND IT IS HEREBY AGREED as follows...the Tenant being an indivdual shall become bankrupt or if the Tenant shall enter into any composition with his creditors or suffer any distress on his goods in the property herein contained the Landlord may re-enter upon the property and immediately thereupon the tenancy shall absolutely determine without prejudice to the ther rights and remedies of the Landlord." So will the landlord defintely be told we are BR? We have always paid rent on time. Thanks for any advice. Sarah
yes the landlord will be told but this clause is usually only invoked when rental payments are not made on schedule. The landlord will know this is not the case so you should be fine.
