new to forum need advise going to go bankrupt next month both me and my husband on disability benefits i also get carers for looking after him. he is on pension credits and incap ben permanetly
we had a joint account but irecently took my name off.I am only going bankrupt not hub. applyed for account in my own name just a basic one . sky and bt are in my name in hubs account to be paid on the original account nos... do i cancel the direct debits or get them changed into hubs name . As im going to be the one bankrupt how will it affect are benefits eg his pen credit as he claims for me . want to do the right thing but with it being joint previous need help......

Hi

as far as the account is concerned it is ok to utilise a 3rd party account when bankrupt.
You can explain this to the examiner at interview.

The pension credits should not be affected either.
It's your husband's claim and therefore his benefit not yours.

Need more help
Thanks for replying to me.can you plese explain a third party account?
What i have is a basic account for me, and husband has kept open the original joint account which i took my name off and closed.
The bt and sky bill are direct debits, on husband account but they are in my name... its these im unsure what to do with . Do i move them to my basic account.
Also my carers and dla are still in hubs account can they remain . what im frightened of is my basic account being frozen when i apply for me to go BR Sorry for punctuation very stressed at present.

Hi

a 3rd party account just means any account, such as your husband's, which you are not connected to.
Therefore it is ok for your benefits to go into his account and it will not be frozen for that very reason, it's not your account. Any DD's paid from his account for payments towards bills in your name is fine - but as I said you will need to explain this to tour examiner when asked.

And your benefits can also be paid into his account.

You don't need an account if you don't want one, everything can go through his.

I have survived the last 3 years without one having pledged never to use a bank ever again following my own bankruptcy.

Thankyou John. My husband says that has took alot of pressure off him that he doesnt have to ring round taking things off his account.
