hi all, my husband has just been to citizens advice with his bankruptcy forms for a specialist person there to help him go through it and amend any mistakes etc. he has been told that altho its just him going bankrupt he needs to take to court on the day my proof of benefits entitlement letters that must be up to date .this means i have to phone up and ask the dwp to send new letters as ive got ones from last year. my questions are-why does he have to take my proof of benefits when im not going bankrupt? i thought he only had to take the bankruptcy form and the fee. the lady at CAB also said he will need to take a letter from the mortgage company stating his arrears and proof of other debts,otherwise the bankruptcy will not be allowed?? the shortfall part of when the mortgage company sells the flat he put on as 1 pound as advised on here but the lady said to put the arrears down instead?im confused! all he has been told today kind of contrasts alot of what is said on this site and i just wondered if somebody could help on these matters.thankyou |

Hi there
Rather than go through each piece of advice your husband received from CAB it is simpler to cover all of the issues with one short answer.
Ignore the advice you have been given as it is completely incorrect. If the CAB rep is a specialist I'm a Dutchman.

some CAB offices give great advice.
this one is not accurate as you will not need this information on the day

I agree that many CAB offices do a sterling job although in respect of Insolvency advice I hear more horror stories than words of praise.
My concern is that in many circumstances, and Insolvency is most definitely one of them, incorrect advice is very damaging. Many believe the advice they receive, because it is the CAB, is bound to be accurate, they put great trust in it.
It's one of the reasons I give what little time I can on here as there is nowhere that I would be prepared to refer anyone for quality free Insolvency advice. That said I am realistic enough to know that we all get things wrong, including me. But CAB advice, or the stories I hear, are all too frequently inaccurate.
What's worse I know of people in the industry that have offered to carry out a weekly surgery for both CAB and the Samaritans free of charge and have been turned away!!!

Just an aside though - you have to ensure you have the up to date benefit confirmation with you otherwise you will not receive the reduction!

I believe the benefit claimant is not declaring bankruptcy, only her husband.

thankyou melanie and john it is only my husband going BR.his only income is carers allowance which i dont think qualifies for the reduction in court costs unfortunately. |
