I recently got 3 months of housing benefit payments paid into my bank account that had been backdated from December when I lost my job(my parents helped me out with paying the rent until it came through). Some of it was used for rent and some will be used for my BR court fee. The rest I would like to give back to my parents - I know that this would be seen as preferential payments to a creditor. Will the OR want to know where this money has gone? Will they want to take the surplus even though it is a benefit payment??

Hi

I suppose if you called it rent arrears following a hold up with your housing benefit, it could be argued that this is not a preferential payment. It will really depend on how strict the examiner is.
