 living off benefits , can they be taken?

hi myself and my husband hav been put in for early discharge and hav an expenditure form to fill in, we live off benefits we get £405 pm income support, £132.80 pm child benefit, £558.72 pm chid tax £263pm disability living allowance and £212.40 pm carers allowance, which is a total income of £1571.92 can any of these benefits be taken off me??? when we originally went bankrupt we had we had a total income of £966 aprox this was from benefits but at the time we were not in receipt of DLA or carers, my little boy has been diagnosed with cerebral palsy and that is why we get the extra money. how much will the o/r except as monthly household expences?? i would really appreciate some advice on this. thanx

Hi

when your income increased with the added benefits you were obliged under the rules of bankruptcy to inform the OR at the time.

In theory OR's are encouraged not to propose IPA's where the only income is via benefits. But if they are high enough the OR can do so.

The child benefit and DLA are not classed as income therefore your current accountable income is £1176.12p.

Unless your circumstances have changed and claimable costs increased or decreased then the allowable expenditure will remain as it was originally. If expenditure has increased, as your income has, this is your chance to adjust your claim figures too.

Not having disclosed your benefit increase is not the end of the world as if the OR now decides to impose an IPA it will run for 3 years from the date of commencement therefore the IPA contributions will not have been affected by your not disclosing the inreased income before now.

thankyou for your advice , i did inform the o/r that i was in reciept of dla but i hav not got round to informing them of carers allowance as this is very recent. will they not think its odd that my outgoings hav gone up ?? my reason for this is i was really struggeling before and family was bailing me out. how much money will they exept for housekeeping and clothes etc...etc...
