Failed IVA
Hi
Hope that you can help please I am currently waiting for a court date it has take a year of hard saving to get the money together to file for bankruptcy , The comapany I am with is not coming back to me at the minute I have a urgent question I am inundated in utility bills they are from my previous address were I was renting with family members it is the gas and electrical , and the council tax on the current address is behind £240 pounds I did not get a staement from them so kept onpaying £100 in the meantime they are not happy about this and sent a summonds to me demand to appear in court and the full amount . would appreciate some advise

Hi Amanda,

I believe you can include any utility bill arrears and council tax arrears up to the date of the bankruptcy.

Hopefully one of the experts will be along to answer shortly.

Has the IVA actually failed i.e. have you received the failure certificate from your IP?

The Council Tax is a debt that you should take seriously as they will take you to court however if you have decided to declare BR then they will save you the £510 BR fee. Telephone them on Monday and advise of your current financial problems and see if there is any way that they can take any token payments to give you a bit of time. Also mention that you are considering BR as this may stop the pressure for the moment and ask them for an up to date statement so you can see exactly what the debt is.

You mentioned that you were renting a previous address with family members; are these children/partner or something else?

Hi

you don't need to appear at the magistrates court for the council tax ( council tax is always taken through the magostrates ocurt rather than the county court).

Arrears can be included in all utilities and council tax for previous tax year ( which yours is)

Additionally they will not be able to process anything if you are likely to be in court in the next couple of weeks.
