I am married, if i were to go bankrupt would it affect my husband and his ability to get credit. All debts are in my name. Also i have a bank loan, does that get cleared off like all the other debts. Also he has a car in his name, would that get taken into consideration by the court or will that be taken away? thank you

Hi,

BR affects the person being declared BR and not anyone else so your husband's credit rating will not be affected by you declaring BR providing any future credit he applies for is under his name and not under your name as well.

The bank loan will be included in the BR so will be written off. IS this a secured loan?

If the car is in your husband's name then it will not be of interest to the OR so won't be a problem.
