| Can anyone help with this? I was made bankrupt in early April. One of my creditors had gone as far as going to court and I had a CCJ against me. It should never have gone that far as I was trying to do all I could but they wanted a large monthly payment. Anyway after I went bankrupt I received from the court an Attachment of Earnings Order. I phoned the court and they said I would have to complete it and send it back (the girl I spoke to admitted she didnt know what the process was in this case as I was bankrupt but best to send back the form anyway). This will mean they will contact my employer and get them to pay me out of my salary. This will be excrutiatingly embarrasing in my workplace. My OR had already said he saw no reason to contact my employer so this is such a disappointment. I spoke to my OR who said that the court are allowed to make the order but not allowed to recieve any money from me! Crazy! He said he'd write to the court and the creditor to confirm that I am bankrupt. What has scared me is that I've just noticed on the form from the court it says failure to return the form completed with my employers details is punishable with 14 days imprisonment! I also wrote to the court with a copy of my BR documentation confirming I am bankrupt but I'm really worried now as I haven't sent the form back. Help, anyone please! |

Hi There,
I only comment on matter's i've been through!!
This happened to me, i went bankcrupt and i had a ccj against me.
I wrote to the court, the creditor and their solicitors advising them of my bankruptcy and the creditor's debt were included in the petiton.
(Write to the creditor and other parties or they may still chase you!)
I never filled in the earning's form and never returned it either, once you advise the court of your bankruptcy and that should be the end of it.
Ring the court and discuss your thoughts.

Hi Dean. Thanks so much for your advice. I have now managed to get through to the court, after numerous attempts. The court officer said that my papers had been passed to the judge last Thursday and that it was most likely that the judge would dismiss the order and that would be the end of it, just as you say.
It was just worrying me because you think you've done all you need to do and then hope for the best but they use alot of scary words which make you wonder if you got it wrong what might happen!

Hi There, Follow up the court with a quick call to make sure they have dismissed the case against you,and if you haven't already done it, send a copy of your bankruptcy notice to all of your creditor's, we paid £510 for this piece of paper,so spread the news!
