Next month (July 2009) is the first month I won't be able to pay my creditors. I was hoping for the well-paid full-time job and it just hasn't materialised. I am thinking "Oh my God... I only have seven days left to file for BR" but having read other posts there seem to be people who are already defaulting long term on payments (they say they are receiving phone calls and letters) and haven't yet filed.
I was under the impression that I had to do it BEFORE I was unable to keep up the payments.
My question then is:-
Could I wait to file? How long could I reasonably wait? What is the advantage of 'putting it off' for a while? Why are others waiting?
My Court (Norwich County Court) do NOT have an appointment system. You walk in any morning between 8.30 and 11.00 and file there and then...
You do not have to have missed any payments before going BR, you just have to be struggling to make your payments - robbing Peter to pay Paul.
If you are going to file, then it will cost you £510 pounds, and a good way of getting these fees together is to stop paying your creditors.
Once you do that, you will get phone calls and letters from your creditors.
Some people are hanging on to save up the fees.
You are supposed to show the judge that you have taken advice about your circumstances as well.
