Hi, my partner is in the process of buying the BI , he is sole owner, negative equity,its worth £100,000, he has sent £463 but today received a letter saying he has to get his own solicitor to ..obtain the consent of the mortgagee..deal with the completion and submission of the stamp duty land tax return and register the transfer at the land registry. we can not afford a solicitor its been a hardship for us and the kids having to pay the £463 but got through another month without ,we thought we were getting back on track then something else pops up my partner is on the verge of a breakdown.
Ive read that you can act for yourself how easy is this to do and what does it entail everybodys advice will be greatly appreciated with many thanks. |

| I think you will have to try to find the money from a friend or relative because the mortgage company have to ok it & if you're not legally trained you could risk making some key mistakes. |

Many people go ahead with the transfer process without a solicitor - technically there is no need and you can save the costs by going it alone. It is a very straightforward process

| Hi Tracey/Melanie I sent my £1 plus £473 as sole owner to buy the BI in my house a month ago. I was also told I needed a solicitor and like yourself could not afford more expense. I did find a solicitor who quoted £700 minimum to deal with the transfer! I wrote to the OR's solicitors and asked for the documents to be forwarded to myself on advice from the forum. I received a TR1 transfer form which I signed and got witnessed just by a friend. I sent this back 10 days ago and have heard nothing since. One of the forum experts said I just have to check with the Land Registry in about 4 weeks that the restrictions have been lifted. I decided to deal with it a step at a time. I'm still not sure if I have to do anything else to ensure my house is safe now. I was wondering Melanie if everything is infact done now that I have signed and sent back the TR1 transfer document. How do you know if it has all gone through ok, do I just check the Land Reg? I will let you know more Tracey as soon as I hear anything. Thanks Christine. |

The process is slwo as the Land Registry have to 'do their bit' if the 4 weeks pass and you have heard nothing give the OR a ring you have nothing to lose by chasing them up

Thanks Melanie. I will do that. I'm not worried how long it takes to go through. I just wanted to know if there was anything else I have to do, or is it just the Land Registry that has to be changed. Sorry to keep going on but if it's all done now I am a very happy person! Tracey, sorry didn't mean to take over your post but I hope this helps you decide what to do. If you want to deal with it yourself just write to or phone the OR's solicitors and ask for the paperwork to be sent to yourself. Good luck!
