my wife as started work since i handed in my petition ,none of the debts i have gone BR over are in her name,and after losing her house through MY failed business,she is not willing to help pay off my debts (more likely to kill me )(1) do i have to tell the OR if she has nothing to do with the debts (2) his the OR likely to take her earning into consideration for any payments i have to make to my creditors --thankyou

Most of us go through the tensions you describe - I knoe the signs well - my fault we lost the business as I had borrowed too heavilly and not told anyone - until too late!!!

Your scenario sould similar - my wife wantedm to kill me I can assure you and 4 months later there are days when we all get so stressed that sharing thorogh this forum in particular is helpful.

I explained the position to my OR and said that my wife is dealing with her debts and does not need to go to BR (she hopes and so do I).

I told the OR my life story - almost 11 hours for my interview - almost a record I believe.

Good luck - most of the people in the OR offices have seen anything and everything and if they can, they will work with you - do NOT give them grief - show your willinness to collaborate on all his/her questions

Good luck - I am sure someone will post wiser words - all I say is I hope you come out better than before you went in...

the OR will expect her to pay a fairshare of the household outgoings depending on her income. she does not have to declare her income but if she doesnot then they will assign 50% of all the household outgoings on your SOA to her, leaving more of your income for an IVA

I think debtinfo means an IPA!

The OR does not have any powers over your wife or the contribution she makes. If she can only afford to contribute to 25% of the household bills then this is the amount you should put on the I&E.

The OR cannot investigate your wife and check her bank statements, ask for wage slips, etc. All you have to say is that the amount she contributes is all your wife can afford as she has her own debts to pay or is on low income, etc.

Do not feel obliged/bullied to put 50% of your wife's wages on the I&E if she cannot afford it. All this will mean is that you will struggle with the IPA (if you get one) and could end up in further financial trouble.

I put how much my part contributes to the household on my SOA, not how much he actually earns and this wasn't questioned.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
