 Please advise how can I declare myself bankrupt ?

I a EU citizen and I've been living in the UK for five and a half years. I own a property in the UK and all of my debt has been taken in the UK. At the moment I am not working at the moment due to illness and I am going through treatment abroad which will last about 6 months and my family is paying for it. I can't afford to pay off my debt as I haven't had permanent job for over a year. Please advise how can I declare myself buncrupt or what is the best course of action.

In the first instance I would go along to your local Citizens Advice Bureau because its free, you will find them in the phone book

Hi Eva

the first thing is to get all of your debts or paper copies of them in a box.

telephone your local court and ask the process. you may even be able to book a court date as some are about 6 weeks further down the line

you can either download the forms from the insolvency web site or collect them from court.

some people are able to complete the paperwork and the whole process themselves others need the help and guidance from experts.

with you going away for 6 months, your centre of main interest (COMI) changes and it may be harder for you to declare BR on your return.

TIMING FOR WHEN TO PETITION FOR BR WILL BE VERY IMPORTANT

alternalty you can ask someone to act with a lasting power of attorney, these are straight forward as long as your nominated person is up to speed with the rules and regulations.

Not all CAB offices will be able to deal with power of attorney issues so i would encourage you to speak to one of the experts. Paul at Reviva has an overseas office and deals with lots of lasting power of attorney
