can i still buy the beneficial interest in my property(for a pound as negative equity)if i have a few late payments on my mortgage record but am now up to date. also could i do it if a month in arrears Are there any restrictions..? many thanks

Hi Bob.1

as i see it the beneficial interest and mortgage payments are two seperate enterties so you being in arrears should not cause a problem.

However nosey question with your best interest at heart, can you actually afford the mortgage ? it is OK to get the BI back from the OR but you once you have taken responsibility for the property, if you get into arrears a second time and cant afford the mortgage it cannnot be included in your initial bankruptcy. so you could be forced back into financial problems.
