Hi all.
I may be due a wage rebate due to underpaid wages since mid 2006.This could be in the region of £2,500!
I went br beggining of June08 and have an IVA of £200permonth starying in sept08.
Will the rebate or % off be taken by the OR?

Do you mean an IPA starting in Sept 08?

You will have to be prepared to lose the full value of your wage rebate to the OR, and you have a duty to inform him/her of this within 42 days of becoming aware it is due.

yes I ment IPA!

The rebate would likely to be paid in a future months wages in about 6 months time.As I have an IPA wouldnt I pay 70% disposable income to the OR, after taking off my outgoings in that months pay?

No - because the rebate would be deemed to be a debt due to you at the date of the bankruptcy order and therefore the full amount would be payable - but no harm in trying to negotiate a lower figure with the OR. You never know your luck might be in!

1)For future reference if was to win the lottery AFTER being dicharged would that go to the OR?
2)Even though the IPA lasts 3 years does that only change with a salary change?
3)At this point in time it seems that if I do overtime at work 70% would go to the OR, so theres no point in working extra!Strange world..

1) No
2) They rarely change once they are set up, but you are duty bound to advise of salary increases - these are normally offset by higher expenditure allowances
3) The OR does not really monitor overtime. They do not have the time or resource, and in my experience of having to police 50% uplifts in my IVA portfolio this rarely results in much higher dividends being returned to creditors.
