I wonder if you could help me? When I went to court on Wednesday the judge granted me a stay of advertisement but I have had two letters now from companies saying sorry to hear you are bankrupt offering their services. I called one last night and they said they got my details from the gazette that the court publishes... is this correct? Surely my address should be left out of everything?

Hi Maizie Have a look online for the London Gazette, link here http://www.london-gazette.co.uk/index.htm then if you go through the browse notices and hilight personal insolvancies then click go, then click bankruptcys and have a look through there to see if your info has been added to that. Mine was in there 3 days after we went BR so they are pretty quick and I also have had letters saying about the "Sorry that your Bankrupt" bit. We are also on the insolvency register link here: http://www.insolvency.gov.uk/eiir/ then have a look through there 2 that went on the next day. They are pretty quick when adding that stuff so it could have got through. :( Take care Jo

No its not on there and should be anyway because I have a stay of advertisement. I have just called my OR and he said he can't understand how they got my details because they shouldn't be published anywhere.
Off to phone the courts now!

Hi maizie I'm afraid that's not how it works, the stay would only cover the local press advertisement.
The London Gazette is a trade paper as such and you would not expect those parties from whom you wish your address to be witheld to be aware of its existence.
This is how banks freeze accounts, through this publication, so if your address were witheld here too you could, in theory, keep your money in a non disclosed account and nobody would be any the wiser.
Unfortunately some less scrupulous businesses within the industry use it as a lead source to sell their product. As if you haven't had enough c&*p in your life of late, they try and extend it by putting you in a position of doubt as to whether or not you've made the right decision.

I really didn't know that! So I have to accept that people know my address... only my OR and my parents know where I am living!!!!

you should cast your mind back to before you came across this site or ever considered BR. Had you ever heard of the Gazette?
I think many people become so engrossed by their situation it gradually comes to feel like it's the norm. We know BR is sadly more widespread than ever but I can't see why those parties that do not know where you are would suddenly decide to read the Gazette online. It's natural to worry but I'm sure all will remain the same as before.

Hi maizie the way I read it, and contrary to what I had understood a stay to mean, your details shouldn't be in the Gazette either. I understood a stay to relate to an advertisement where as the Gazette entry is a matter of record.
Call the OR straight away and quote the details of your stay. Ask him how long it will take to get the Gazette entry removed.

Thats what I thought! I can't find it on the Gazette, unless it has been taken off! They must have got my address from somewhere!

Hi maizie you might try calling the same company again and explaining that your details are not in the Gazette and ask, again, where they got them from.
It's possible that a creditor may "sell" these as leads to 3rd party companies when they are notified of your BR by the OR.

I don't really know what to do next. I called the company yesterday, first they said it was the gazette. I checked the gazette, nothing on there. I called today, they said they are provided a list by the courts. I called the courts, they said they do not issue any lists and as soon as you go bankrupt only the OR is informed. I called my OR who said that it wasn't published. The insolvency register states address withheld. Basically I was bankrupt on the 15th (Friday) but with the court making a major mistake I didn't notify my OR of my intended stay of advertisement until Monday morning. Wednesday Stay of advertisement was agreed. OR had put things on hold until notification came through.
I don't know what else to do, do I contact the OR again? I don't want to appear a pain!

I guess it depends how helpful the OR's exaaminer wants to be.
Fax him a copy of the letter you received and ask him to follow this up, and quote the reason for the stay again to reiterate why you are very distressed over the situation. You also need to establish where the "leak" occured.

I have contacted the company again who have now said that it was the courts agents that they get the details from?!!!! What the?!!!! He said could he call me back after he delves into where he got the details from. I refused to give my mobile number and said I would call him in ten.
I contacted my OR who has been so helpful through all this, he said that it hasn't even been published yet, and definately no address will be published on the insolvency register, local paper(s) or gazette.
He said he can guarantee that the OR department have not issued it so its down to the court. OR said that maybe I should get legal advice?

Right!!! I have just contacted the company again, there are two places they get the details from... The Gazette (myself and OR have checked.. its not on there and it hasn't even been published) and the Insolvency Register. I went bankrupt on Friday, apparantly this would have been put on the register the next working day i.e. Monday. I called OR Monday afternoon regarding the stay of advertisement. Could it have been put on with my address then taken off again once they knew about the stay of advertisement?
